Lifted train binding at Deutsche Bahn: is there a duty to re-check the booked connection once the DB Navigator suggests an alternative?

The ticket is a Sparpreis or Super Sparpreis, the discounted Deutsche Bahn fares that are tied to specific trains (Zugbindung, train binding), for a journey with at least one change of train. The first train runs late, and the DB Navigator app reports that the booked connection can no longer be made. The app prompts for an alternative, and the alternative is adopted. From that moment the app no longer displays the original connection and sends no further notifications about it. The first train then makes up part of the delay, so the original connection at the interchange station would have been reachable after all. Nothing in the app shows this. The journey continues on the alternative, possibly on a train of a higher product class, such as an ICE instead of the booked IC.

The question is whether there was a duty, before changing trains, to check again whether the originally booked connection had become reachable. In practice it decides whether the journey on the alternative train was covered by the ticket. For a change into a higher product class without a valid ticket, the conditions of carriage provide for a surcharge notice, a Fahrpreisnacherhebung (clause 3.8.1, https://www.bahn.de/agb).

The answer is no. The right to continue on a different train arises the moment the delay is announced through one of the information channels named in the conditions of carriage, and DB’s own timetable information service is named there explicitly. If the situation improves afterwards, the right does not lapse retroactively. The reasoning follows from the wording of the conditions of carriage in the edition of 26 October 2026 and from DB’s help pages, quoted below. The German original of each quotation is the binding text; the English renderings are working translations only. A German version of this page exists and is linked at the top.

The right attaches to the forecast

Clause 9.1.1 of the conditions of carriage:

— Beförderungsbedingungen der DB AG, edition of 26 October 2026, BB Personenverkehr clause 9.1.1 — https://www.bahn.de/agb

Working translation: where it must reasonably be assumed that the traveller will arrive at the destination station named in the contract of carriage at least 20 minutes late because of a delay, a missed connection or a cancellation, the traveller has, even with a train-bound ticket, an immediate choice, towards the rail undertaking that owes the delayed or cancelled service, between continuing the journey at the next opportunity, possibly by a different route, and continuing it at a later time. A train of a higher product class may be used. Reservation-compulsory trains and special trains may not.

The trigger is the expectation of a delay, not the course events actually took. The choice exists unverzüglich, immediately, at the moment of knowledge. The clause contains no condition under which the choice lapses again.

The app’s message makes the expectation reasonable

Clause 9.1.4 defines when the expectation counts as well-founded:

— Beförderungsbedingungen der DB AG, edition of 26 October 2026, BB Personenverkehr clause 9.1.4 — https://www.bahn.de/agb

Working translation: the traveller may reasonably expect a delay under clauses 9.1.1 and 9.1.3 in particular where it has been announced through at least one of the following channels: posted timetables and posted information about timetable changes at stations; electronic displays and announcements on trains and at stations; timetable information from the booking systems of staffed sales points; and available timetable and passenger information media, in particular the online timetable information service at www.bahn.de. Transfer times for scheduled connections follow that same electronic timetable information service. The same applies where the traveller can present a confirmation issued by the carrier or the station operator showing such a delay.

Deutsche Bahn thereby designates its own timetable information service as the authoritative channel, and the transfer times held in it as the yardstick for whether a connection counts as reachable. A traveller who relies on that information meets the condition of the clause exactly. No further duty of verification is imposed anywhere.

Choosing an alternative does not change the ticket

DB’s help page for the DB Navigator describes what selecting an alternative does:

— https://www.bahn.de/faq/pk/service/buchung/navigator/funktionen

Working translation: important: when you select an alternative connection, you keep your original ticket. Only the information shown in the travel plan and the notifications for the journey are adjusted. Please check beforehand whether your ticket is valid for the selected alternative.

Selecting an alternative is therefore a display setting. It creates no new train binding and removes no existing right. That the original connection disappears from view afterwards is a property of the app.

The scope of the lifted binding

DB’s help page on lifted train binding:

Sie können mit Ihrem ursprünglichen Ticket alle DB Fernverkehrszüge (ICE, IC/EC) und Nahverkehrszüge (RE, RB, IRE, S-Bahnen) nutzen. […]

— https://www.bahn.de/faq/zugbindung-aufgehoben-bedeutung

Working translation: the original ticket may be used on all DB long-distance trains (ICE, IC/EC) and regional trains (RE, RB, IRE, S-Bahn). A later connection of the traveller’s choice may be used, later the same day, a day later or three weeks later, up to one year after the original travel date. The route may be chosen freely. Within Germany no additional certificate confirming the lifted binding is required. For tickets with train binding, such as Sparpreis fares, the binding is lifted automatically.

A validity window of up to a year is hard to reconcile with the idea that the lifting could expire the same day, the moment the original train becomes reachable again.

The counter-argument

It can be objected that clause 9.1.1 requires a forecast, and that a forecast must hold at the moment the decision is made. If the situation visibly improves before the decision is acted on, the forecast would be superseded and would have to be corrected.

The objection does not carry as far as a duty to re-check, for three reasons.

First, clause 9.1.1 grants the choice unverzüglich, at the moment of knowledge. The clause describes a point in time, not a state to be monitored continuously.

Second, clause 9.1.4 sets out what makes the expectation well-founded: announcement through one of the listed channels. No obligation to reconcile that announcement against later operating conditions is set out there.

Third, such an obligation would require checking the carrier’s information against the carrier’s own app, which stops displaying the original connection precisely once the alternative has been selected. An obligation that could only be met by working around the obligor’s own user interface cannot be derived from this wording.

What remains correct in the objection is that the forecast must have been sound at the moment of decision. That is exactly what clause 9.1.4 supplies, by naming announcement through the timetable information service as a sufficient basis.

Limits

  • Reservation-compulsory trains and special trains are excluded. Clause 9.1.1 rules them out explicitly (quoted above). According to DB’s help page on lifted train binding, reservation-compulsory trains are marked „durch ein ‚R’-Symbol an der Zugnummer im Fahrplan” (working translation: by an “R” symbol next to the train number in the timetable) (https://www.bahn.de/faq/zugbindung-aufgehoben-bedeutung).
  • Not every alternative offered is covered by the ticket. That is what the sentence „Bitte prüfen Sie vorher, ob Ihr Ticket für die ausgewählte Alternative gültig ist” in the app’s help page is aimed at (quoted above). Clause 9.1.2 provides for contracts with companies that do not apply the conditions of carriage only where DB fails to inform the traveller of the onward options within 100 minutes (https://www.bahn.de/agb).
  • Not every deviation lifts the binding. DB lists an expected delay at the destination of at least 20 minutes on domestic journeys, a cancelled train, a cancelled stop, a missed connecting train, and an earlier departure caused by a timetable change (https://www.bahn.de/faq/zugbindung-aufgehoben-bedeutung). What counts is whether one of these applies, not the app’s prompt to choose an alternative.
  • Regional tickets work differently. The same help page: „Bei Nutzung eines höherwertigen Zugs (z.B. Deutschland-Ticket, Länder-Tickets).” (Working translation: a higher-class train such as an IC/EC or ICE requires an additional ticket, whose cost can be reclaimed from the passenger-rights service centre; this does not apply to heavily discounted tickets such as the Deutschland-Ticket or regional state tickets.) (https://www.bahn.de/faq/zugbindung-aufgehoben-bedeutung)

Evidence

A screenshot of the message, taken before the alternative is selected, serves as evidence. Once the alternative has been adopted, the app no longer shows the message about the original connection.

Within Germany no certificate is required. According to DB, one can be issued „auf expliziten Wunsch” (on explicit request), „z.B. im Zug, im Reisezentrum oder an der DB Information” (for example on the train, at a travel centre or at a DB information desk) (https://www.bahn.de/faq/zugbindung-aufgehoben-bedeutung). Clause 9.1.4 names such a confirmation explicitly as a further basis for a well-founded expectation (quoted above).

Standing of this analysis

The assessment rests on the wording of the conditions of carriage and the cited help pages. No published case law on this precise constellation is apparent. The conditions of carriage are reissued several times a year; the edition quoted is that of 26 October 2026, and clause numbering may shift in later editions.

The statutory framework is Regulation (EU) 2021/782 on rail passengers’ rights and obligations, to which clause 9.1.2 of the conditions of carriage itself refers. Its Article 18(1) ties continuation by a different route to an expected delay of “60 minutes or more” (https://eur-lex.europa.eu/eli/reg/2021/782/oj/eng). The 20-minute threshold for domestic journeys is a contractual provision of Deutsche Bahn and goes beyond the Regulation.
